Boat Cops' reply on Drama Boat:
Every State and the Federal Govt. have laws/regulations that prohibit "Careless, Reckless, or Negligent" operation of a watercraft.
Loosely defined, that means any operation of a boat that can cause injury to persons or damage to property.
No one can argue that there is potential for someone to fall off the back of the boat in this particular situation. Getting blenderized by the prop aside, drowning/falls overboard is the leading cause of deaths on recreational boats.
There would be no way to specify each and every way that people kill themselves on boats. The law books would be bigger than the King James Bible, so the "careless, reckless, negligent" is a cover-all that we, as law enforcement, must articulate to get such a charge to stick.
Is there a specific law that says you can't ride on the roof, hood or trunk lid of a car? I don't know of any, but you sure as hell would get pulled over for doing it.
It's true that Honcho got out of a ticket for a similar action, but only because the Officer wasn't prepared to articulate in court his position. He knew it was wrong, but couldn't say why. The Judge can only rule on the evidence/testimony before him, and the Officer brought nothing to testify to. Sarcasim, Just one more thing that I offer for free!!
