LOS ANGELES - A superior court jury in Los Angeles awarded $21.7 million Tuesday to a Covina woman severely injured while riding a personal watercraft in 2008.

Fabiola Esparza, of Covina, suffered a permanent brain injury at 15-years-old while a passenger on a Polaris Industries personal watercraft that collided with a boat on the Colorado River near Blythe.  
Esparza's attorneys largely blamed a Polaris manufacturing defect, which cut the watercraft's steering when the driver released the throttle.
The court found Polaris Industries liable for $11.5 million of the total award, with the remainder divided between the driver of the boat, Donald Lane, and the unnamed driver of the personal watercraft. Lane testified he turned his boat in front of the personal watercraft to protect three grandchildren on an inflatable boat tied behind it

The jury found the driver of the personal watercraft liable for 20 percent of the award.

Polaris sympathized with Esparza in a statement but disagreed with the jury, saying their vehicle was safe and the accident was caused by excessive speed, alcohol and reckless driving.

I feel bad for the young girl but why sue Polaris? Did they make the jet ski driver drink and drive? Did Polaris have control of the throttle?  I don't know any of these people and don't own any Polaris products, I have had stand-up and set down jets skis and a jet boat back in the 70's the steering problem is not something new.  Maybe a little training for jet ski drivers (they are several that need it these days) Just my opinion.  This will costs us all in the long run.

Not just jet ski's, but any water craft is too easy to go and buy and run to the water way with out any training to operate and know the ways of the water. You can tell the people that do not have a clue on what they are doing. Sad Polaris is footing the bill for some dumb a$$.

I see the most problems with RENTALS, both watercraft and boats.
Nascar marks the rookie cars with an Orange spoiler to let the drivers know when approaching a rookie, maybe all rentals should be bright orange to warn other boaters :good

I think the Deep Pockets payouts always filter down to our empty pockets :cry

I like that idea. Paint them things a bright a$$ orage or nuclear green. You know as well as I do most renters have no clue. They just want to get on the water and have fun. Of coarse there are those owners that are the same way. Bright orange stripe on the bow and stern of those that have not taken water craft safty coarse and can only be removed by coast guard when they have their license/certificat of completion.

Last week I was driving down Dobson and rolled up next to this gal that was texting while driving. As we came to a stop at a light she looked at me, I was shaking my head looking at her. She reached over to the passenger seat and set her phone down with an ah $hiat busted look on her face. She put both hands on the wheel and drove off when the light turned green. Didn't even give me another look.

Why can't they set these phones that if they are moving faster than 10mph that the phone kills calling and texting functions. That would keep folks from causing accedents and killing people.

That's a great idea and can be easily done, truckers that have Qualcom in their tractors can't reply to messages unless they pull over and come to a complete stop. :good
