After finding Michael Clarence Tims guilty, a jury assessed a five-year prison sentence Thursday in the first felony boating while intoxicated trial in Harrison County. Â Tims, 47, of North Franklin Street, was also fined $5,000.
District Attorney Joe Black said there have been misdemeanor BWI trials, but this was the first felony case.
After imposing sentence, 71st District Judge Bonnie Leggat Hagan set a $50,000 appeal bond for Tims.
"If he makes bond, he must surrender his driver's license," Black said. "He cannot consume alcohol" while the case is on appeal and "he cannot operate any kind of motorized vehicle."
The DA said he was "very pleased" with the verdict. "Boating while intoxicated cases are difficult to prove," he said, adding he believed the jury thought Tims to be "a potential threat and a danger" to Harrison County citizens.
The five-man, seven-woman jury deliberated for two hours and 45 minutes before returning the guilty verdict and spent another hour and 10 minutes determining punishment.
The prosecution's testimony during the punishment phase of the trial consisted solely of the DA reading a list of Tims' prior offenses.
