About a month ago I was driving out to Temecula with my wife in an '06 Totyota Corolla rental she had while her car was in the shop.
The entrance to the carpool lane is just after our on-ramp, but a tight squeeze when there is traffic.
It was "Rush Hour" so of course, everyone was bumper-to-bumper and it was difficult getting over in that tight window of opportunity.
By the time I'm all the way over I'm just slightly past the entrance and there are absolutely no cars at all in the carpool lane...so I go in.
My wife even looked back and there was no one to be seen for at least a mile.......and for good reason.

There was a CHiPpy way back there goin' about 55 and everyone was lined up behind him. Hindsight tells me he was creating an opportunity for a sucka like me.

Well he guns it and catches up to us about 5 miles down the road and pulls us over to the side. I give him my info and he tells me it's not a moving violation...I ask if I can attend traffic school, he says yes, if I haven't been for at least 18 months....no problem - 3 years.

I find out later it is a point on your record for crossing the line....even with two in the car.
No points for driving in the carpool lane with only one occupant :stupid

So I get the courtesy notice in the mail...send in a check for the bail ($351.00) and a non- refundable check for traffic school ($39.00) and figure I'll just get this behind me.

Yesterday I get both checks back in the mail with a form letter that has the box checked indicating that traffic school is not an option for that citation. That I either have to pay the bail or make an appointment to appear.

My question is (to anyone who may have gone through this, or works at a court) is why didn't they just keep my check?

Any special reason I would have to appear? I called the pre-recorded info line and it says that if an appearance was mandatory it would say so on the notice I got.

Any law enforcement personnel out there with the scoop? :confused

The thing that irks me the most is that the whole carpool lane idea was to cut down on congestion and reduce gas usage...here I am driving one of the most economical cars made....with two (3 counting the dog) in the car and an empty carpool lane! :angry

And I can't even resolve it! :(

Man that sucks!!! Good luck with that!!  Here in AZ you can jump in and out of the car pool lane at anytime as long as there are 2 poeple in the car of corse.

All I can say is dealing with the courts is the most frustrating thing EVER!!!  Noone know what the frik is going on, and they all just tell you to go somewhere else.... :angry

I swear the people at the local court by me are all the people that got fired from the DMV :banghead

They just raised the fine, so they may be cracking down, Or this may be a place with a bunch of offenders and you got caught in a trap. either way it sounds like B.S. :angry

Ahhh, I see.  Last time I was out there, I noticed the 3 person car pool lanes, kinda was wondering WTF???  But figured it was just Cali as usuall.  :D

The ticket was for VC Sec. 21655.8 (a) Crossing over double yellow lines to enter or exit a preferential use traffic lane.

The other thing I found out is: Vehicle Code Section 21655.3 states, in part, that a high occupancy lane shall be separated from adjacent mixed-flow lanes by a buffer area of at least four feet in width. That is mandated by the legislature....and I only crossed a double yellow, no more than 2 feet wide. :angry

But I'm not a lawyer....I just play one on TV. :D

An easy solution,  stay outta the car pool lane and race down the highway on the shoulder :D   I see cars doing that all the time without getting a ticket, but jump into a carpool lane and they get ya (Whether you're legal or not)

And said I had until May 18 to take care of it......why isn't anything ever easy? I wanna know why they just didn't keep the check for the bail amount? :stupid

Something similar to me happend many years ago. I was "stuck" in the car pool on ramp side and the cop was just sitting there waiting for me. focker! Thats when the fine was just $271.

Good luck with this, vilolations suck ass especially when you didnt mean to do them. Where was the cop yesterday when a motorcylce was speeding weaving in traffic?  I would have been surprised if that guy made it home last night.  :guns

They even call them HOV lanes instead of carpool lanes. lol  :)

I got popped for the same thing several years ago on the 5 in OC.  I paid the fine as I remember was closer to $400 and went to traffic school without issue.  They wouldn't let me do online traffic school though, at least at that time.

If I remember right if it's not a moving violation, you can't go to traffic school, unless they've changed it??. :stupid I remember getting popped for for a non moving violation and they wouldn't let me go!.. :stupid

Long sections of the Double yellow paint is missing from the carpool lanes in OC.

Damfino why, looks like the paint just peeled up and blew away like caution tape.

With the paint gone, It looks like an entrance op, we ducked in thinking we were following the rules, and we got stopped anyway.
