About a month ago I was driving out to Temecula with my wife in an '06 Totyota Corolla rental she had while her car was in the shop. The entrance to the carpool lane is just after our on-ramp, but a tight squeeze when there is traffic. It was "Rush Hour" so of course, everyone was bumper-to-bumper and it was difficult getting over in that tight window of opportunity. By the time I'm all the way over I'm just slightly past the entrance and there are absolutely no cars at all in the carpool lane...so I go in. My wife even looked back and there was no one to be seen for at least a mile.......and for good reason.
There was a CHiPpy way back there goin' about 55 and everyone was lined up behind him. Hindsight tells me he was creating an opportunity for a sucka like me.
Well he guns it and catches up to us about 5 miles down the road and pulls us over to the side. I give him my info and he tells me it's not a moving violation...I ask if I can attend traffic school, he says yes, if I haven't been for at least 18 months....no problem - 3 years.
I find out later it is a point on your record for crossing the line....even with two in the car. No points for driving in the carpool lane with only one occupant
So I get the courtesy notice in the mail...send in a check for the bail ($351.00) and a non- refundable check for traffic school ($39.00) and figure I'll just get this behind me.
Yesterday I get both checks back in the mail with a form letter that has the box checked indicating that traffic school is not an option for that citation. That I either have to pay the bail or make an appointment to appear.
My question is (to anyone who may have gone through this, or works at a court) is why didn't they just keep my check?
Any special reason I would have to appear? I called the pre-recorded info line and it says that if an appearance was mandatory it would say so on the notice I got.
Any law enforcement personnel out there with the scoop?
The thing that irks me the most is that the whole carpool lane idea was to cut down on congestion and reduce gas usage...here I am driving one of the most economical cars made....with two (3 counting the dog) in the car and an empty carpool lane!
And I can't even resolve it!
It's a fact of Life:
After Monday and Tuesday, even the Calendar says : WTF .......

Man that sucks!!! Good luck with that!! Here in AZ you can jump in and out of the car pool lane at anytime as long as there are 2 poeple in the car of corse.

Ahhh, I see. Last time I was out there, I noticed the 3 person car pool lanes, kinda was wondering WTF??? But figured it was just Cali as usuall.

Besides, a bunch of peeps that use them drive below the speed limit so it's a gamble to get in them. Â Â You might have to go several miles before you can exit again.  |
Not in AZ. We can zip in and out when ever we want too.
They even call them HOV lanes instead of carpool lanes. lol   |
HOV= High Occupancy Vehicles!..

If I remember right if it's not a moving violation, you can't go to traffic school, unless they've changed it??. I remember getting popped for for a non moving violation and they wouldn't let me go!..
