Cruising down I-19 yesterday heading to work I got rear ended by a gang banger in a SUV! My car actually looks pretty good after the wreck but his had to be towed because of extensive front end damage.
DPS estimated his speed at 85+ and mine at 70 at the point of impact. I was in the fast lane and had to brake for a car that pulled out in front of me from the slow lane. On impact his vehicle lifted the rear of mine and sent me into the slow lane sideways. I am really glad there were no injuries except for my sore neck.
Focker had no insurance and my little back and forth to work beater is not worth fixing so I need to look for another car :angry
First accident I have ever been in and I hope it was the last!
The kid received 4 citations and the DPS officer told me he will loose his license due to the circumstances of the wreck. I hope he learned something that he can remember :stupid

Man, Sorry to hear that.  Glad you're ok  :good   Sounds like it could have been a lot worse based on his speed.   Sounds like the Cop Gods were watching over you and nailed this guy to the wall.  Let's hope all the charges stick.

The Cop Gods definitely had my back :good  the 5min it took for them to arrive at the accident seemed like an hour. All I could think of was somehow I am going to get screwed on this deal. No tickets for me so I am very happy about that!

Glad to hear you are OK! That's the important thing. Although I'm sure you're happy to hear the A-hole had ins. afterall. :D

Now if I could get Mojave Insurance, the carrier for Swift, to resolve my issue from last week when their graduate from the Helen Keller School of Trucking hit my car, I'd be a happy camper too!  :banghead

This is confusing?

Who gives a damn who's fault it was. Your insurance should be hooking you up and taking care of business with the other guy. You should be good to go in about a week, if you have complete coverage.

Glad you're alright physically. It may take some time for you to heal mentally. These kinda things fry me...

Dickhead I talked to on the phone says my story "the truth" does not match his customer’s description of the incident, imagine that??? I have an appointment scheduled to talk with my agent and she thinks at this point that there should be no problem getting a settlement. The police report is all the evidence I need.
They are just dragging their feet I guess it is to be expected!

Well insurance companies don't make millions by paying out claims.

I wouldn't even talk to the other party's insurance company. Speak to yours and let them work it out while your car gets fixed/replaced. It shouldn't work the other way around. Don't let them give you the run around.

Do you at least have a rental car?

I only have liability coverage on that car so no rental car :angry My POS was probably only worth $1500 or so, I'm probably not going to see much $$$ from the deal.
Someone from his insh co called today and I referred them to my agent and asked them to direct all conversation through her.

Sorry to hear about this Wade.  This same situation happened to me a few years ago.  Of course the lady that hit me told a completely different story to her insurance company.  They claimed I was at fault as well.  I said "I don't think so. The police report cited her as the cause."  They asked if they could see it so I drove it down to their office.  They cut me a check on the spot. :)

I think you woke up real sore this morning....can hardly move huh? Damn, those soft tissue injuries are very hard to diagnose. In fact, it's not unusual for them to appear several days after a rear-ender. :eek

KC is right about them wanting to write things off fast when injuries are involved.  :angry I really dislike Insurance adjusters...... :guns

Lokk up the car on KBB.com and also look it up on auto trader.com and any other place that you can find to get the value of what it will cost to replace it.

Good advice, because their insurance company is gonna lowball you. NEVER except their first offer.

I would also g to a chiropractor who offers massage therapy and get a couple of weeks of treatment on their dime as well.

Hope you're feeling well and this gets over quickly, but I doubt it will. You may want to get an attorney, since you don't have comprehensive coverage and the party is not your friend. All they want to do is get out of this for as little as possible.

Best of luck to you.
