Iowa lawmakers fear proposed drunken boating law may be too tough

In the wake of an Okoboji boating death involving a Sioux Falls man, some Iowa lawmakers say they’re worried about a proposed law that would toughen drunken boating laws in that state.
A bill, which was approved unanimously in the Iowa Senate, would lower the blood-alcohol limit for boaters from 0.10 percent to 0.08 percent, the current limit for driving on Iowa roads.
It must still be approved by the House and signed by Gov. Chet Culver before it becomes law.
House Majority Leader Kevin McCarthy, D-Des Moines, said some lawmakers, including himself, fear the new limits may be too tough.
“It may not be politically correct or politically popular to say so, but there’s a day-and-night difference between driving on the road and on the water,†McCarthy said.
“Accidents rarely, rarely, if ever, happen on the water due to alcohol consumption," he said. "It’s just a fact.â€
Boaters found to be impaired can face up to a $1,000 fine, two days in jail and lose their boating license for a year.
Brenda Krumel, president of the Polk County chapter of Mother’s Against Drunk Driving, said the group supports tougher laws for drunken boaters.
“There needs to be a serious message ... because the results are that people can lose their lives,†Krumel said.
Jill Brosnahan urged lawmakers to toughen the state’s drunken boating laws after her husband was killed in an August 2005 boating accident on West Lake Okoboji, near Spirit Lake.
Michael Brosnahan, a Perry dentist, was killed when the boat he and his wife were in was struck by a boat operated by Justin Nearman of Sioux Falls.
Nearman pleaded guilty to operating a boat while intoxicated resulting in the death of another person.
He was sentenced to 10 years in prison, with half of that sentence suspended.
