The AZ sheriff said that the judge could involk a sentace of 6 months plus fines and insurance and attorney cost.  He tested just over the 1.5.  He is panicked, if the sentance sticks he will most likely loose his job.  His wife had to raise $1800 in cash to post bond. |
Your buddy better get a really good attorney. "the judge could.....", judge Would give him 6 months. That's the minimum these days. He best be panicked, they don't lose many of these cases. You did'nt mention the 18 month alcohol class or the ignition lock-out devices. Don't they have these in AZ? |
They use the ignition-lock usually when someone has had several DUI's. If that guy has a good lawyer and if it's his first time, then he may get a work-release sentence.

I was guessing prior's because of the bail. Here in CA, 4 hours in drunk tank, and your out with Notice To Appear. Work Release, I forgot about that. That's got to be horrible too. Guess it's better than losing everything.

He tested over 1.5?? He was driving that thing pretty f#cked up then, huh? I'd be willing to bet this wasn't his first time either, just the first getting caught.

At .15, I'm not even sure I could get in my boat. I'll try the roll & tumble entry. Then I'll have to find the damn keys that my wife seemed to misplace.

| Quote (David @ June 28 2007,3:27 pm) | Yes this was his first offence. Â I too have been told that AZ has .8 and 1.5 offence guideline, and that the 1.5 is automatic extreme. Â But I too have been told about the breath interlock system everyone is now getting. Â Imagin that on your boat too. Â Not sure if you could get an interlock on a boat, bet you cant't? Â However as to him being able to drive to work. Â If they give him 6 months in jail, he can't drive to work. Â Right now he has a very expensive attorney and is sweating it.
He was picked up with several others in a stop leaving the canal. Â They also found that his extinguisher was expired by (2) months. Â This was not a fun day for him at Havi.
No matter what this will be a very costly experience for him. Â |
First offense, that's good news for him. AZ also has .00-.03 and .03-.05 and .05-.08. I don't think they put inter-locks on boats, but they could. If like CA, he can't drive now. That Hilton person tried it. Being picked up with several others isn't his best defense. Expired extinguisher. This poor soul's life just got changed possibly forever. He doesn't have the time to worry about a $25.00 fit it ticket.

| Quote (malibuken @ June 29 2007,7:57 am) | I know I have started being more responsible when driving and not drinking to excess like in my younger years. Most of the folks we go out with are the same way. Â Not really that bad, in fact it I can actually remember what happened at the sand bar now when I am the DD. Â Â As opposed to waking up the next day with no recollection of the prior days events. Â Â |
Yep, I slowed down too. And just in case, boat does'nt get wet without my DD. Memmories, 500+ trips to Crazy Horse, and all I remember is looking for a camp site. Now a carry the camera.
