That POS was still on the streets, with a local rap sheet that long... Ya wonder sometimes if our court system is really doing "justice" for the people...

Alan, why would assault and battery on a peace officer only be a misdemeanor? |
I don't know how it works over in CA, but Resisting Arrest and Assault on a Peace Officer (with no injuries) are fairly low level felonies. They can be reduced to misdemeanor for plea reasons. Although I don't agree with it, it's common for them to be reduced.
What would be misdmeanor assault, say just shoving someone, for a normal person, turns into Felony Aggravated Assault if the assaulted is a Peace Officer.
But some prosecutors feel that it's in our job description to be assaulted by dirtbags.
And for Shueman's question, the justice system doesn't protect the victims. It protects the criminals.

| Quote (Havasu Doug @ Oct. 12 2007,9:21 am) | Well it's finally over. He was convicted of assault with a deadly weapon other than a firearrm and was sentenced to 150 days in jail and 3 years probation. Â He changed his plea on that count to "guilty" and the robbery charge was dismissed. Â I don't know how much of the 150 days he will serve, but he's already been in jail since this happened over 2 months ago. |
seems like a minor amount of time considring he threatened a life, no matter how threatening or not the encounter may have been. Personally, I think some of these criminals like being in jail because the outside world is phucked up so bad.... . Glad its all behind you now Doug....I was called as witness to a crime before and I wasn't even around, my cleaning/janitorial folks found the guy in a closet and nearly made them shiat their pants.

I agree on that not seeming like a very long sentence, but at least he is a convicted felon now. All the other cases I mentioned were misdemeaners. Also, I was not looking forward to taking the witness stand. At least I don't have to now.
